Terms of Service

The rules of engagement for using Deep Seer.

These Terms of Service ("Terms") govern your access to and use of the Deep Seer platform ("Service"), operated by Deep Seer ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Deep Seer is a geospatial open-source intelligence (OSINT) platform that aggregates publicly available data from government agencies, scientific organizations, and open data providers. The Service displays this data on an interactive 3D globe and provides analytical tools including AI-powered analysis, correlation detection, investigation management, and reporting.

Deep Seer does not generate, create, or fabricate data. All data displayed originates from third-party public sources including but not limited to: USGS, NOAA, NASA, EPA, FAA, FEC, SEC, FBI, CDC, OpenSky Network, AISStream, GDELT, ACLED, ICIJ, and OpenStreetMap.

2. Account Registration

You may use certain features without an account. To access Pro or Enterprise features, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

You must be at least 16 years old to create an account. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

3. Subscription Tiers & Billing

3.1 Free Tier

The Free tier provides access to 90+ data layers, basic visualization, search, geofencing, and limited AI features (50,000 AI tokens per day, 5 AI messages per minute). The Free tier is provided at no cost and may be modified or discontinued at any time.

3.2 Pro Tier ($29/month)

The Pro tier includes all Free features plus: AI spatial queries, document intelligence, AI-powered reports and analysis, investigation workspace, contextual briefings, data export, and higher usage limits (500,000 AI tokens per day, 30 AI messages per minute).

3.3 Enterprise Tier ($99/month)

The Enterprise tier includes all Pro features plus: Google Maps 3D Tiles, TomTom live traffic, Copernicus Sentinel-2 imagery, split-screen viewer, network graph visualization, and highest usage limits (5,000,000 AI tokens per day, 120 AI messages per minute).

3.4 Usage-Based Overage

Pro and Enterprise subscribers who exceed their daily AI token quota are not blocked. Instead, usage above the included quota is metered and billed as overage: $10 per 1 million tokens (Pro) or $5 per 1 million tokens (Enterprise). Free tier users are hard-capped with no overage option. Overage charges are billed monthly via Stripe.

3.5 Billing & Cancellation

Subscriptions are billed monthly via Stripe. You may cancel at any time through the "Manage Billing" button in the app. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months. If payment fails, your account will be downgraded to the Free tier until payment is resolved.

5.1 Public Data Sources

Data displayed on the Service originates from third-party public sources. We do not guarantee the accuracy, completeness, timeliness, or reliability of any third-party data. Data may be delayed, incomplete, or contain errors inherent to the source.

5.2 User-Generated Content

You retain ownership of content you create within the Service, including investigation notes, evidence annotations, custom analyses, and reports. By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

5.3 AI-Generated Content

AI-generated analysis, briefings, reports, and other outputs are provided for informational purposes only. AI outputs may contain errors, hallucinations, or inaccuracies. You are solely responsible for verifying AI-generated content before relying on it for any purpose, including but not limited to legal proceedings, journalistic reporting, or decision-making.

6. Evidence Integrity

The Service provides cryptographic integrity features (SHA-256 hashing, HMAC signing, RFC 3161 timestamping, OpenTimestamps) designed to support chain-of-custody requirements. While these features use industry-standard cryptographic methods, we do not guarantee that evidence processed through the Service will be accepted by any court, tribunal, or legal body. Admissibility is determined by the applicable jurisdiction and presiding authority.

7. Privacy & Face Detection

Face detection and matching features (when available) process all data entirely in the user's browser. No facial data, embeddings, or biometric information is transmitted to our servers. These features require explicit user consent before activation and include an ethics gate that cannot be bypassed. You are solely responsible for ensuring your use of these features complies with applicable privacy and biometric data laws (e.g., BIPA, GDPR, CCPA).

8. Intellectual Property

The Service, including its design, code, algorithms, and documentation, is the intellectual property of Deep Seer and is protected by copyright and other intellectual property laws. Third-party data is subject to the respective licenses of its source (see our Privacy Policy for details).

Open-source components used in the Service are subject to their respective licenses (MIT, Apache 2.0, etc.).

9. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL DEEP SEER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify and hold harmless Deep Seer, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) any content you create or submit through the Service.

11. Third-Party Services

The Service integrates with third-party APIs and data providers. Your use of data from these sources is subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or policies of third-party services.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

13. Modifications

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Delaware.
